Terms of Service

These terms form a binding agreement between you and Old Mill Country Store, Inc. governing your use of our website, mobile app, and online ordering.

Section 16 contains a binding arbitration agreement and a class action waiver that affect how disputes are resolved. You may opt out of arbitration within 30 days of first accepting these terms. Please read it carefully.

1. Acceptance of these terms

By accessing or using the Services, creating an account, or placing an order, you agree to these Terms of Service and to our Privacy Policy. If you do not agree, do not use the Services.

2. Eligibility

You must be at least 18 years old and able to form a binding contract to create an account or place an order. Some products, including certain animal health items, propane, and firearms- adjacent accessories, carry additional age, licensing or jurisdictional restrictions that we enforce at fulfillment.

3. Your account

You are responsible for the accuracy of the information you provide, for keeping your password confidential, and for all activity under your account. Notify us immediately at support@oldmillcountrystore.com if you suspect unauthorized use. We may suspend or terminate accounts that violate these terms or present a security or fraud risk.

4. Orders, pricing and availability

  • Your order is an offer to purchase. We accept it when we confirm fulfillment or hand over the goods; until then we may decline or cancel any order.
  • Product descriptions, images, weights and availability are provided in good faith but may contain errors or become out of date.
  • If an item is listed at an incorrect price or with incorrect information, we may cancel the order and refund you in full, even after a confirmation email.
  • We may limit quantities, refuse service, or restrict fulfillment to our delivery area.
  • Prices exclude applicable Washington state and local sales tax, which is added at checkout.

5. Payment

Payment is processed by third-party payment providers. You represent that you are authorized to use the payment method you provide. Authorization holds may appear on your statement before the final charge. We do not store full payment card numbers.

6. Pickup, delivery and shipping

Pickup and delivery windows are estimates, not guarantees. You are responsible for providing safe access for delivery, for accurate delivery instructions, and for inspecting goods on receipt. Risk of loss passes to you on pickup or delivery. Bulk feed, hay and heavy items may have additional handling terms disclosed at checkout.

7. Returns and refunds

Unopened, unused merchandise in resalable condition may generally be returned within 30 days with proof of purchase. For health, safety and regulatory reasons we cannot accept returns of prescription items, opened animal health products, vaccines or other temperature-controlled goods, special orders, cut goods, or items marked final sale. Refunds are issued to the original payment method. Contact us before returning any item.

8. Gift cards and promotions

Gift cards are redeemable for merchandise, are not redeemable for cash except where required by law, and do not expire under Washington law. Coupons and promotions are subject to their stated conditions, may not be combined unless stated, have no cash value, and may be withdrawn at any time. We may void promotions obtained through error, fraud or abuse.

9. Pharmacy and animal health

Our pharmacy services are provided by licensed personnel and are subject to applicable pharmacy laws and, where relevant, a valid prescription and a valid veterinarian-client-patient relationship. Submitting a refill request through the Services is a request only; it is not filled until confirmed by our pharmacy staff.

Product descriptions, feeding guidance, blog articles and staff suggestions are general information, not veterinary or medical advice. Always read and follow label directions, observe withdrawal periods for food animals, and consult a licensed veterinarian or physician before acting. Never use the Services for a medical emergency — call 911 or your veterinarian.

10. Acceptable use

  • Do not use the Services for any unlawful, infringing, deceptive or harmful purpose.
  • Do not scrape, crawl, harvest, or use automated means to access the Services except for well-behaved search engine indexing.
  • Do not attempt to probe, scan, breach, or circumvent security or authentication measures, or access accounts or data that are not yours.
  • Do not resell, reverse engineer, decompile or create derivative works from the Services.
  • Do not upload malware, spam, or content that is defamatory, obscene, or violates another person’s rights.
  • Do not interfere with the operation of the Services, including through excessive request volume.

11. Your content

If you submit reviews, photos, messages or other content, you grant us a non-exclusive, worldwide, royalty-free license to use, display and distribute it in connection with the Services. You confirm you own or have permission to submit the content. We may remove content at our discretion and are not obliged to monitor it.

12. Intellectual property

The Services, including text, graphics, logos, software and layout, are owned by Old Mill Country Store, Inc. or its licensors and are protected by copyright, trademark and other laws. Brand names and product images belong to their respective owners. Nothing in these terms transfers any ownership to you.

If you believe material on the Services infringes your copyright, send a DMCA notice with the required elements to support@oldmillcountrystore.com.

13. Electronic communications and text messages

You consent to receive communications from us electronically, including order confirmations, receipts and legal notices, and agree that they satisfy any legal requirement that they be in writing. If you opt in to text messages, message and data rates may apply; reply STOP to cancel or HELP for help. Consent to marketing texts is not a condition of purchase.

14. Disclaimer of warranties

Except where prohibited by law, the Services are provided “as is” and “as available” without warranties of any kind, whether express, implied or statutory, including implied warranties of merchantability, fitness for a particular purpose, title and non-infringement. We do not warrant that the Services will be uninterrupted, error-free or secure, or that product information is complete or current. Manufacturer warranties on products, where offered, are unaffected.

15. Limitation of liability

To the maximum extent permitted by law, Old Mill Country Store, Inc. and its owners, employees and suppliers will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, revenue, data, livestock, crops or goodwill, arising out of or relating to the Services, however caused. Our total aggregate liability for any claim will not exceed the greater of the amount you paid us for the order giving rise to the claim or US$100.

Some jurisdictions do not allow certain exclusions or limitations, so parts of this section may not apply to you. Nothing in these terms limits liability for fraud, personal injury caused by negligence, or any other liability that cannot be limited by law.

16. Dispute resolution, arbitration and class waiver

Informal resolution first. Before filing a claim, contact us at support@oldmillcountrystore.com and give us 30 days to resolve the issue.

Arbitration. If we cannot resolve the dispute, you and we agree that any dispute arising out of or relating to these terms or the Services will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, seated in Yakima County, Washington, rather than in court. The arbitrator decides all issues except that a court decides the enforceability of the class waiver.

Class action waiver. Claims may be brought only in an individual capacity and not as a plaintiff or class member in any class, consolidated or representative proceeding.

Exceptions. Either party may bring an individual claim in small claims court, and either party may seek injunctive relief in court for intellectual property or unauthorized access claims.

30-day opt-out. You may reject this arbitration agreement by sending written notice with your name, address and account email to 1504 S 36th Ave, Yakima, WA 98902 within 30 days of first accepting these terms. Opting out does not affect any other part of these terms.

17. Governing law and venue

These terms are governed by the laws of the State of Washington, without regard to its conflict of law rules. Where arbitration does not apply, the state and federal courts located in Yakima County, Washington have exclusive jurisdiction, and you consent to that jurisdiction and venue.

18. General terms

  • Indemnity: you agree to indemnify and hold us harmless from claims arising out of your misuse of the Services or violation of these terms or applicable law.
  • Force majeure: we are not liable for delays or failures caused by events beyond our reasonable control, including weather, supply disruption, labor action, outages or government action.
  • Severability: if any provision is unenforceable, the rest remains in effect.
  • No waiver: our failure to enforce a provision is not a waiver of it.
  • Assignment: you may not assign these terms; we may assign them in connection with a merger, acquisition or sale of assets.
  • Entire agreement: these terms, together with the policies linked here, are the entire agreement between us.

19. Changes to these terms

We may update these terms. Material changes take effect 30 days after we post them or notify you, except changes required by law, which take effect immediately. Continuing to use the Services after that date means you accept the updated terms.
